Supreme Court dismisses plea of Nagaland retired employees

Kohima, Jul 7 : The Supreme Court has given its ruling in favour of the Nagaland Government in the law suit filed by the Nagaland Senior Government Employees Welfare Association (NSGEWA) against their retirement, thus ending the tussle between the state and its employees.

Official sources here today said the apex court gave the ruling in favour of the state government yesterday and dismissed the appeal of the petitioners NSGEWA against the implementation of the Nagaland Retirement from Public Employment (Second Amendment) Bill 2009, which was passed in the Nagaland Assembly in July last year.

The verdict came after a series of hearings from November 6 last year and the open court had adjourned the case till January 19.

However, the case was taken up on February 9 and the third hearing was on May 4 and finally the judgement delivered yesterday.

Earlier, the NSGEWA had also lost the battle in Gauhati High Court on October 31 last year, after which the organisation had filed a Special Leave Petition in the Supreme Court arguing that it was their Constitutional Right to serve the government and that they cannot be simply thrown away by passing an Act.

The implementation of the Act is expected to create over 3500 vacancies in the state government.
